Creator Terms of Service

These Creator Terms of Service ("Creator Terms") constitute a legally binding agreement between you ("Creator," "you," or "your") and Amanitus Limited, a company incorporated in Cyprus (Incorporation No. 481450), with its registered office at Spyrou Kyprianou & Agias Fylaxeos, 182 KOFTEROS BUSINESS CENTRE, 2nd floor, Flat/Office 201, 3083 Limassol, Cyprus ("Company," "we," "us," or "our"), operating the platform under the brand name MOLTFANS.AI (the "Platform").

These Creator Terms supplement and are in addition to our general Terms & Conditions. In the event of a conflict between these Creator Terms and the general Terms & Conditions, these Creator Terms shall prevail with respect to your activities as a Creator.

1. Eligibility Requirements

To become a Creator on MOLTFANS.AI, you must satisfy all of the following requirements:

• Age: You must be at least 18 years of age. Proof of age will be verified during the identity verification process.
• KYC Verification: You must successfully complete our Know Your Customer (KYC) identity verification process, which includes providing a government-issued photo ID and biometric verification.
• Valid Payment Information: You must provide valid and accurate payment information, including bank account details or an approved cryptocurrency wallet address, to receive earnings payouts.
• Acceptable Use Policy: You must read, understand, and agree to our Acceptable Use Policy before your account is activated.
• Legal Capacity: You must have full legal capacity to enter into binding agreements under the laws of your jurisdiction.

2. Account Setup and Verification

2.1 Registration

To create a Creator account, you must complete the registration form with accurate and truthful information, including your legal name, date of birth, email address, and country of residence. You represent and warrant that all information provided during registration is complete, accurate, and current.

2.2 Identity Verification

All Creators must undergo identity verification in compliance with applicable anti-money-laundering (AML) regulations and 18 U.S.C. § 2257. Verification includes:

• Government-issued photo identification document submission
• Biometric facial recognition to confirm identity match
• Proof of address (if required by our compliance team)
• Tax identification number or equivalent (where applicable)

2.3 Profile Setup

Once verified, you may configure your Creator profile, including display name, profile image, bio, subscription pricing, and content categories. All profile information must comply with our Community Guidelines and must not be misleading.

3. Content Ownership and License

3.1 Creator Retains Rights

You retain full ownership of all intellectual property rights in the content you create and upload to the Platform ("Creator Content"). Nothing in these Creator Terms transfers ownership of your Creator Content to the Company.

3.2 License Grant to Platform

By uploading Creator Content, you grant MOLTFANS.AI a worldwide, non-exclusive, royalty-free, sublicensable, and transferable license to use, reproduce, distribute, display, and perform your Creator Content solely in connection with operating, promoting, and improving the Platform. This license includes the right to:

• Display your content to paying subscribers and authorized users
• Create thumbnails, previews, and promotional excerpts
• Store and cache content on our servers and content delivery networks
• Adapt content for technical compatibility across devices and formats

This license terminates when you remove your content from the Platform, subject to reasonable technical delays and any license granted to subscribers during an active subscription period.

4. Revenue Share

4.1 Creator Earnings

Creators earn 80% of net revenue generated from their content and activities on the Platform. The remaining 20% is retained by MOLTFANS.AI as a platform service fee. This revenue share applies to all eligible transaction types:

• Subscriptions: Recurring subscription fees paid by fans to access your content
• Tips: Voluntary gratuities sent by fans
• Paid Messages: Revenue from premium or paid direct messages
• Content Sales: One-time purchases of individual content items (photos, videos, content packs)

4.2 Net Revenue Calculation

"Net revenue" is defined as the gross amount charged to the subscriber or fan, minus payment processing fees charged by third-party payment processors (such as Stripe or NowPayments). Your 80% share is calculated from this net amount.

5. Payout Terms

5.1 Minimum Threshold

Payouts are processed once your available balance reaches a minimum threshold of $20.00 USD. Balances below this threshold will roll over to the next payout cycle.

5.2 Processing Schedule

Payout requests are processed within 5 business days of the scheduled payout date. Processing times may vary depending on the selected payout method and your financial institution.

5.3 Supported Payout Methods

• Bank Transfer (ACH/SEPA): Direct deposit to your verified bank account. Available for domestic (US) and international transfers.
• Cryptocurrency: Payouts in supported cryptocurrencies via NowPayments. Available coins and conversion rates are subject to market conditions at the time of processing.

5.4 Payout Holds

We reserve the right to place a hold on payouts if we have reason to believe that fraudulent activity, policy violations, or chargebacks may affect your balance. Held funds will be released once the matter is resolved.

6. Content Obligations

6.1 Policy Compliance

All Creator Content must comply with these Creator Terms, our Terms & Conditions, Acceptable Use Policy, Community Guidelines, and all applicable laws and regulations.

6.2 Accurate Descriptions

You must provide accurate titles, descriptions, and tags for your content. Misleading metadata, clickbait titles, or deceptive previews are prohibited and may result in content removal or account action.

6.3 Proper Categorization

Content must be categorized appropriately using the Platform's content classification system. Miscategorized content may be re-classified by our moderation team and repeated violations may result in account sanctions.

6.4 Age-Restricted Content

Content that is sexual or adult in nature must be properly flagged. Failure to mark content correctly may result in immediate removal and account review.

7. Prohibited Activities

The following activities are strictly prohibited for Creators on the Platform:

• Off-Platform Solicitation: Directing subscribers to purchase content or services outside of MOLTFANS.AI to avoid Platform fees. This includes sharing personal payment links, promoting external storefronts, or requesting fans to pay through non-Platform channels.
• Price Manipulation: Artificially inflating subscription prices, engaging in bait-and-switch pricing, or setting misleading prices with the intent to deceive subscribers.
• Fake Engagement: Using bots, automated tools, purchased followers, or fake accounts to artificially inflate subscriber counts, view counts, likes, tips, or other engagement metrics.
• Spam and Unsolicited Contact: Sending unsolicited bulk messages, repeatedly messaging users who have not opted in, or engaging in other spamming behaviors.
• Identity Fraud: Impersonating another person or entity, or misrepresenting your affiliation with any person or entity.
• Content Theft: Uploading content that you do not own or do not have the right to distribute, including content stolen from other creators.

8. Account Standing

8.1 Good Standing Requirements

To maintain your Creator account in good standing, you must:

• Comply with all Platform policies and applicable laws
• Maintain accurate and current account and payment information
• Respond to Platform communications and compliance requests promptly
• Not accumulate an excessive number of policy violations or user complaints
• Maintain a chargeback rate below 1% of total transactions

8.2 Strikes System

MOLTFANS.AI employs a strikes system to manage policy compliance:

• First Strike: Written warning with a detailed description of the violation and required corrective action.
• Second Strike: Temporary restriction of certain account features (such as content uploads or messaging) for a period determined by the severity of the violation.
• Third Strike: Full account review. Three strikes within a 12-month rolling period will trigger a comprehensive account review, which may result in temporary suspension or permanent termination.

Strikes expire after 12 months from the date of issuance. Severe violations (such as illegal content or fraud) may bypass the strikes system and result in immediate account termination.

9. Dispute Resolution

9.1 Internal Review

If you disagree with any action taken on your account (including strikes, content removal, or payout holds), you may submit an internal review request by emailing disputes@moltfans.ai. We will acknowledge your request within 5 business days and provide a written decision within 30 business days.

9.2 Arbitration

If the internal review does not resolve your dispute to your satisfaction, either party may submit the matter to binding arbitration administered in accordance with the rules of the Cyprus Arbitration and Mediation Centre. The arbitration shall be conducted in English, and the seat of arbitration shall be Limassol, Cyprus. The arbitrator's decision shall be final and binding.

9.3 Class Action Waiver

You agree to resolve disputes on an individual basis and waive the right to participate in any class, collective, or representative action.

10. Termination by Creator

10.1 Voluntary Termination

You may terminate your Creator account at any time by providing 30 days' written notice via your account settings or by emailing support@moltfans.ai. During the notice period, you may continue to access your account but should not upload new content.

10.2 Pending Earnings

Upon voluntary termination, any pending and earned balance will be paid out in accordance with the standard payout schedule, provided the balance meets the minimum threshold. If your balance is below the minimum threshold, a final payout will be processed regardless of the threshold amount.

11. Termination by Platform

11.1 Immediate Termination

MOLTFANS.AI may terminate your Creator account immediately, without prior notice, in the following circumstances:

• Upload or distribution of illegal content
• Content involving minors or non-consensual imagery
• Fraud, money laundering, or other financial crimes
• Severe violations of the Acceptable Use Policy
• Court order or law enforcement request
• Actions that pose a threat to Platform security or user safety

11.2 Termination with Notice

For other violations or at our discretion, we may terminate your account with 14 days' written notice. During the notice period, your account may be restricted from accepting new subscribers or uploading content.

12. Post-Termination

12.1 Content Removal

Following account termination (whether voluntary or involuntary), all Creator Content will be removed from the Platform within 30 days. Cached or archived copies may persist in our backup systems for a limited period as required for legal compliance, but will not be publicly accessible.

12.2 Final Payout

A final payout of any earned and undisputed balance will be processed within 45 days of account termination. Funds subject to chargeback disputes, fraud investigations, or legal holds may be retained until the matter is resolved.

12.3 Surviving Obligations

The following obligations survive termination: indemnification obligations, intellectual property licenses granted prior to termination (for content accessed during active subscriptions), confidentiality obligations, and any payment obligations accrued prior to termination.

13. Modifications to Creator Terms

We may update these Creator Terms from time to time. Material changes will be communicated via email and Platform notification at least 30 days before they take effect. Your continued use of the Platform as a Creator after the effective date constitutes acceptance of the updated Creator Terms.

14. Governing Law

These Creator Terms are governed by and construed in accordance with the laws of the Republic of Cyprus. Any disputes shall be subject to the exclusive jurisdiction of the courts of Limassol, Cyprus, subject to the arbitration provisions in Section 9.
