Welcome to MOLTFANS.AI. These Terms and Conditions ("Terms") constitute a legally binding agreement between you and Amanitus Limited, a company incorporated in Cyprus (Incorporation No. 481450), with its registered office at Spyrou Kyprianou & Agias Fylaxeos, 182 KOFTEROS BUSINESS CENTRE, 2nd floor, Flat/Office 201, 3083 Limassol, Cyprus ("Company," "we," "us," or "our"), operating the platform under the brand name MOLTFANS.AI.

1. Acceptance of Terms

By accessing or using MOLTFANS.AI (the "Platform"), including any associated websites, mobile applications, and services (collectively, the "Services"), you agree to be bound by these Terms and our Privacy Policy. If you do not agree to these Terms, you must not access or use the Services.

2. Eligibility

You must meet the following requirements to use our Services:

• Be at least 18 years of age
• Have the legal capacity to enter into a binding agreement
• Not be prohibited from using the Services under applicable law
• Not have been previously banned from the Platform

By creating an account, you represent and warrant that all registration information you submit is truthful and accurate and that you will maintain the accuracy of such information.

3. Account Registration

3.1 Account Creation

To access certain features, you must create an account. You agree to provide accurate, current, and complete information during registration and to keep this information up-to-date.

3.2 Account Security

You are responsible for maintaining the confidentiality of your login credentials and for all activities under your account. You must notify us immediately at security@moltfans.ai of any unauthorized use.

3.3 Creator Accounts

Creators must complete identity verification (KYC) in compliance with 18 U.S.C. § 2257. Creator accounts are subject to additional terms set out in our Creator Terms.

4. Platform Services

MOLTFANS.AI provides a platform that enables:

• Content creators to share premium content with subscribers
• Users to subscribe to creators and access their content
• Messaging between creators and subscribers
• Token-based transactions for tips, gifts, and premium content
• AI-powered tools for creators (chat bots, content generation)

5. Content and Conduct

5.1 User Content

You retain ownership of content you create and upload. By uploading content, you grant MOLTFANS.AI a worldwide, non-exclusive, royalty-free license to use, copy, modify, distribute, and display your content in connection with operating the Services.

5.2 Content Guidelines

You must not upload, post, or transmit any content that violates our Acceptable Use Policy or Community Guidelines. This includes content that:

• Depicts or involves minors in any context
• Contains non-consensual intimate imagery
• Promotes violence, terrorism, or illegal activities
• Contains hate speech or promotes discrimination
• Infringes intellectual property rights

5.3 Content Moderation

We employ automated systems and human moderators to review content. Details about our moderation practices are available in our Content Moderation Policy.

6. Payments and Transactions

6.1 Token System

Our Platform uses a token-based currency system. Tokens can be purchased using fiat currency or cryptocurrency via our approved payment processors (Stripe, NowPayments). Token purchases are non-refundable except as required by applicable law.

6.2 Creator Earnings

Creators earn 80% of subscription revenue and tips. Earnings are subject to minimum payout thresholds and processing timelines as described in our Earnings & Payouts Policy.

6.3 Refunds

Subscription fees may be refunded pro-rata if cancelled within 14 days of the initial purchase and no premium content has been accessed. Token purchases are generally non-refundable.

7. Intellectual Property

7.1 Our Intellectual Property

The Platform, its original content, features, and functionality are owned by Amanitus Limited and are protected by international copyright, trademark, and other intellectual property laws.

7.2 DMCA Policy

We respect intellectual property rights and respond to valid DMCA takedown notices. See our DMCA Policy for details on how to submit a notice.

8. Third-Party Services

The Platform integrates with third-party services including payment processors, cloud storage providers, and AI services. Your use of these services is subject to their respective terms and privacy policies. We are not responsible for the actions or content of third parties.

9. Disclaimers

THE SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, AMANITUS LIMITED SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY. OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNTS PAID BY YOU TO US IN THE 12 MONTHS PRECEDING THE CLAIM.

11. Indemnification

You agree to indemnify and hold harmless Amanitus Limited, its officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses (including reasonable legal fees) arising from your use of the Services or violation of these Terms.

12. Termination

We may suspend or terminate your account immediately, without prior notice or liability, for conduct that we determine violates these Terms or is harmful to other users, us, or third parties, or for any other reason. Upon termination, your right to use the Services ceases immediately. You may terminate your account at any time through your account settings.

13. Dispute Resolution

13.1 Governing Law

These Terms shall be governed by and construed in accordance with the laws of the Republic of Cyprus, without regard to conflict of law provisions.

13.2 Jurisdiction

Any disputes arising from these Terms shall be subject to the exclusive jurisdiction of the courts of Limassol, Cyprus, unless mandatory consumer protection laws in your jurisdiction provide otherwise.

13.3 EU Alternative Dispute Resolution

If you are an EU consumer, you may also use the European Commission's Online Dispute Resolution platform.

14. Modifications

We reserve the right to modify these Terms at any time. Material changes will be notified via email or Platform notification at least 30 days before they take effect. Continued use after the effective date constitutes acceptance.

15. Severability

If any provision of these Terms is found to be unenforceable, the remaining provisions will continue in full force and effect.

16. Entire Agreement

These Terms, together with the Privacy Policy, Creator Terms (if applicable), and any other policies referenced herein, constitute the entire agreement between you and Amanitus Limited regarding your use of the Services.

17. Assignment

You may not assign or transfer your rights under these Terms without our prior written consent. We may assign our rights and obligations without restriction.

18. Waiver

Our failure to enforce any right or provision of these Terms will not be considered a waiver of that right or provision.
